Litigation Dept.
Robert is a partner and head of our litigation department, having qualified as a solicitor in 1995 following the completion of his training with the firm. Robert practices in all areas of civil litigation and in particular specialises in employment law, clinical negligence claims and personal injury law.
Employment Law
Robert acts extensively for both employers and employees and advises on all aspects of employment law including redundancy, unfair dismissal, wrongful dismissal, TUPE transfers, sex discrimination, race discrimination and age discrimination. He represents both employers and employees in employment tribunal claims and for employers Robert also advises upon and drafts contracts of employment, in house policies and compromise agreements.
Some of the cases that Robert has acted upon include securing a substantial sum of damages for an employee who had been subjected to a lengthy and sustained campaign of homophobic bullying which affected the employee’s health and meant that he could not return to work as a result, acting on behalf of a female employee who was subjected to sexual harassment over a period of time and obtaining damages for her, acting on behalf of a female employee whose job role was changed upon her return from maternity leave and successfully negotiating a settlement in respect of a constructive unfair dismissal claim when the employee decided to leave her employment as a result of her treatment.
Robert always considers the bigger picture when advising his clients and ensures that his clients obtain full and frank advice on all the important issues, including the commerciality of bringing or defending a claim. Amongst Robert’s clients are a well-known high street retailer and several transportation companies. Robert also acts regularly for international clients, in particular clients based in the USA and Canada.
Robert is a member of the Employment Lawyers Association (ELA) and also regularly lectures upon employment law.
Clinical Negligence
Robert acts on behalf of individuals who have suffered as a result of medical negligence. Such claims can be complicated and fraught with difficulties but Robert always advises in a clear and concise manner to enable his clients to decide whether or not to pursue their claim. Amongst Robert’s notable successes in this field was negotiating a settlement on behalf of a client in a claim against a surgeon for negligence when an operation was unsuccessful (which in itself was not negligence) but where the surgeon had failed to warn the client of the potential outcomes of the surgery, the impact of such outcomes upon her and the risk involved.
Personal Injury
Robert acts predominantly for individuals in claims for compensation for injuries sustained as a result of accidents they have been involved in and that arose as a result of negligence of others. In particular Robert has acted for a number of clients with serious long-term injuries and subsequently brought proceedings and/or negotiated settlement of such claims on behalf of his clients. Provided that there is a better than 50% chance of success, Robert acts for his clients in personal injury matters upon a “no win, no fee” basis. Among the notable cases that Robert has acted upon, he represented the Claimant in the matter of Slater v Bancroft (1999) CA in which he successfully appealed the trial judge’s finding that a driver in an incorrect lane on a multi-lane roundabout was not negligent when altering her position without warning.
Robert is a member of the Association of Personal Injury Lawyers (APIL).
Other Litigation
Robert also has experience in all other areas of litigation including claims in probate and under the Inheritance (Provision for Family and Dependents) Act 1975 and contract disputes.
